We gather certain information about you. Information about you is also used by our affiliated entities and group companies, namely InBody Co. Ltd, of InBody Bldg., 54, Nonhyeonro-2-gil, Gangnam-gu, Seoul 06313, South Korea (our ‘group company’).
When you select a local InBody body composition analysis device provider (usually at a health club) (an “Analysis Facility”) that Analysis Facility will have access to your data and will be a ‘data processor’.
We collect personal information about you (such as your name; address: mobile phone number; e-mail address; gender; height; age; weight; intra- and extra-cellular water; dry lean mass; body fat mass; total body weight; date of birth; date of registration with us; and dates, times and notes/memos of body composition analysis tests when you register with us or purchase products or services from us. We also collect personal information when you contact us, send us feedback, post material to our website, compete customer surveys or participate in competitions.
If you are under the age of 16, your registration and your data protection consent must be approved by the person with parental responsibility for you. You have to provide us with the mobile phone number of such responsible person which we will use to obtain such approval. You will be able to use the App only after such approval has been granted. If approval has not been granted within 10 days, we will delete your personal data.
Occasionally we may receive information about you from other sources (such as your Analysis Facility), which we will add to the information we already hold about you in order to help us provide products and services, and improve and personalise our service to you.

We use the Measurement Data to display data, including your historic values, in the InBody App. This includes an analysis of your Measurement Data in result sheets. In addition, we make this data available to the Analysis Facility via a secure online platform (“LookinBody Web”).
From your Measurement Data we calculate an overall Fitness Score ranging from 0 to 100. The ranking functionality allows you to share your Fitness Score with specific friends, who are in the contact list of your mobile phone and have installed the App. By default sharing is inactive.
Users of the Analysis Facility (e.g. your trainer) can upload a profile picture of you which is then accessible by you and the Analysis Facility. You will be automatically notified of such an upload. If you do not want a profile picture to be uploaded or to have it deleted, please contact the Analysis Facility.
For information on the further use of Measurement Data by the Analysis Facility (such as the provision of health advice) please see the privacy notice of the Analysis Facility.
If you give us information on behalf of someone else (such as a child, see above), you confirm that the other person has appointed you to act on his/her behalf and has agreed that you can:
• give consent on his/her behalf to the processing of his/her personal data;
• receive on his/her behalf any data protection notices;
• give consent to the transfer of his/her personal data abroad; and
• give consent to the processing of his/her health information.
We may ask you to provide sensitive personal information, for example when you register or update your information, or undertake a measurement at an Analysis Facility.
Sensitive personal information includes information relating to your physical health or condition.
This Measurement Data will be used as set out above in the section titled ‘Personal information provided by third parties’.
We will only collect your sensitive personal information with your explicit consent when you undertake a measurement at an Analysis Facility.
The processing will take place based on your consent. Where you have given consent to any data processing, you have the right to withdraw that consent at any time.
We process information about you for the following reasons:
• to carry out the contract between us
• to help us identify you and any accounts you hold with us;
• to provide you with an analysis of your Measurement Data, e.g. result sheets;
• compliance with legal, regulatory and corporate governance obligations and good practice
• gathering information as part of investigations by regulatory bodies or in connection with legal proceedings or requests
• ensuring business policies are adhered to
• operational reasons, such as recording transactions, training and quality control
• ensuring the confidentiality of commercially sensitive information
• investigating complaints and allegations of criminal offences
• customising the App and its content to your particular preferences;
• to notify you of any changes to the App or to our services that may affect you;
• statistical analysis
• preventing unauthorised access and modifications to systems
• analysing preferences and improving services
• providing customer services
We collect information about your Use of the App (“Usage Data”), such as which buttons have been clicked or functions have been used, and login dates. We use this data to improve and further develop the App or to rectify defects of the App. We keep Usage Data separate from your personal data, i.e. we process it on a pseudonymous basis. If you do not want us to collect data about your usage of the App you can opt-out in the setup menu of the App.
You can access, correct and delete your data within the App. You can also delete your account directly within the App from the setup menu.
Your data is encrypted both when it is stored on your mobile phone and on our server. In addition data is transferred between your mobile phone, our servers and the Analysis Facility via a secure encrypted internet connection. We use data centres provided by Microsoft which following internationally recognized data security standards and provide a highly secure platform.
While we will use all reasonable efforts to safeguard your personal data, you acknowledge that the use of the internet is not entirely secure and for this reason we cannot guarantee the security or integrity of any personal data that are transferred from you or to you via the internet.
We gather information directly from you and also via our websites, App and other technical systems. These may include, for example, our:
• computer networks and connections
• communications systems
• email and instant messaging/chat systems (“Chat Content”)
• mobile phone applications
• [insert any other relevant systems] and other hardware and software owned, used or provided by or on behalf of us.
Device information
We may also collect information about your device each time you use the App. For example, we may collect information on the type of mobile device that you are using and its unique device identifier (for example, the IMEI number, the device’s mobile phone number, or the MAC address of the device’s wireless network interface), the type of mobile browser that you are using, the mobile operating system that you are using, mobile network information, the time zone setting and [insert any other information collected].
The Inbody App requires the following permissions from your mobile phone:

Information on your device
We may also collect information which is stored on your device each time you use the App. For example, we may collect contact information, login information, friends lists, photos, videos and other digital content, app name, app version, user ID, model of mobile phone, date of mobile phone manufacture, and the type and version of OS used. To enable you to share your Fitness Score with friends (see below), we use the data from your device solely for the ranking functionality. Your name and phone number are stored on our servers. We also need the information on your device and app history to monitor the status of the App.
Location data: We may also use GPS information to provide a Bluetooth connection – however the location information is not stored or collected by us.
The InBody App allows you to chat with employees of the Analysis Facility, e.g. your trainer at a health club. The content of your chat is visible to you, your chat-partner and the Analysis Facility.
We may monitor and record communications with you (such as telephone conversations and emails) for the purpose of improving the quality of our services and preventing fraud.
Use of cookies
A cookie is a small text file which is placed onto your computer (or other electronic device) when you use our website or App. We use cookies to track your IP address, type of web browser and the type of OS being used on our website to:
• recognise you whenever you visit the website or App (this speeds up your access to the website or App as you do not have to log on each time); and
• make your online experience more efficient and enjoyable.
This information helps us to build a profile of our users. Some of this data will be aggregated or statistical, which means that we will not be able to identify you individually. We may obtain information about your device such as your IP address, your browser and/or other internet log information. In certain circumstances we may collect personal information about you—but only where you voluntarily provide it (e.g. by completing an online form) or where you purchase goods or services from us.
You can set your browser not to accept cookies. However, some of our website features may not function properly as a result.
We may disclose your personal data to:
• other companies within our group;
• our agents and service providers;
• law enforcement agencies in connection with any investigation to help prevent unlawful activity
• your Analysis Facility;
• a third party who acquires InBody or acquires substantially all of our assets, in which case the personal data shall be one of the acquired assets;

We will use technical and organisational measures to safeguard your personal data, for example:
• access to your account is controlled by a password and user name that are unique to you;
• we store your personal data on secure servers; and
• payment details are encrypted using SSL technology (typically you will see a lock icon or green address bar (or both) in your browser when we use this technology).
While we will use all reasonable efforts to safeguard your personal data, you acknowledge that the use of the internet is not entirely secure and for this reason we cannot guarantee the security or integrity of any personal data that are transferred from you or to you via the internet. Your data is stored on our server. In addition, a copy of your data is stored in the App on your mobile phone (synchronization) in order to reduce data traffic and provide offline functionality of the App. Our servers are located in Europe. However, we may need to transfer your personal data out of the European Economic Area to our group company’s servers in South Korea. Any transfer of your data will be subject to a European Commission approved contract that will safeguard your privacy rights and give you remedies in the unlikely event of a security breach.
Your consent
Under applicable data protection laws it is necessary to obtain your consent when personal data is accessed from, processed and/or transferred to a country outside the European Union (EU) and European Economic Area (EEA). Therefore, you are asked to give consent to the transfer upon registration.
Your data will be held in accordance with our retention policy. In general, We store your data until you delete your InBody account. When you uninstall the App, your data (personal data, Measurement Data and Chat Content) will be deleted from your device but remain on our servers. If you delete your InBody account this data will also be deleted from our servers. The Analysis Facility may keep copies of your data for other purposes and longer periods (e.g. due to statutory retention periods). Please see the privacy notice of the Analysis Facility for details.
You have a number of important rights, which can be exercised free of charge. You have the right to request:
• access to your personal information and to certain other supplementary information that this Privacy Notice is already designed to address
• require us to correct any mistakes in your information which we hold
• require the erasure of personal information concerning you in certain situations
• receive the personal information concerning you which you have provided to us, in a structured, commonly used and machine-readable format and have the right to transmit those data to a third party in certain situations
• object at any time to processing of personal information concerning you for direct marketing
• object to decisions being taken by automated means which produce legal effects concerning you or similarly significantly affect you
• object in certain other situations to our continued processing of your personal information
• otherwise restrict our processing of your personal information in certain circumstances.
Where you have given consent to any data processing, you have the right to withdraw that consent at any time. We will not do anything with your data not outlined in this notice.
